Workers own their passport. Your career record belongs to you — not your employer, not FORGE. We will never sell your data. This app is a tracking tool, not a legal compliance system.

1. About FORGE

FORGE is a digital skills tracking and verification platform for Australian trades workers, apprentices, supervisors, and companies. It is operated by Forge Company Australia (ABN 64 749 148 495), a sole trader business registered in South Australia.

By creating an account or using FORGE, you agree to these Terms. If you don’t agree, don’t use the platform.

Important: FORGE is a tracking and record-keeping tool only. It does not replace your legal training contract, your RTO assessment, or any formal apprenticeship paperwork required under South Australian law. Nothing in FORGE constitutes legal compliance or a formal competency certification.

2. Who Can Use FORGE

By creating an account, you confirm that the information you provide is accurate and that you have the authority to use the platform in the role you have selected.

3. Worker Accounts — Free Forever Always free

Apprentice, labourer, and supervisor accounts are free and will stay free. No trial period, no credit card required, and no future obligation to pay for personal use of FORGE.

4. Company Accounts Paid

Company accounts require approval from FORGE before access is granted. Once approved, company accounts operate on a paid subscription. Pricing is communicated directly at the time of activation.

Subscriptions are billed as agreed at sign-up. FORGE will provide reasonable notice before any pricing changes. You may cancel at any time, but no refunds are provided for partial billing periods unless required by Australian Consumer Law.

FORGE reserves the right to suspend or revoke company account access for breach of these Terms.

5. Data Ownership — Your Passport Belongs to You

Every job record, photo, skill tag, and piece of content you log as a worker is yours. It belongs to you — not your employer, not FORGE.

Workers retain ownership of all content they upload, including photos. Certain viewing and download access rights for companies are set out in Section 6.

When a supervisor verifies a job, they are confirming your work. That verification does not transfer ownership of the record to them or their company.

If your employment ends, the company loses access to your records through their FORGE dashboard. You keep full access to your passport — always.

6. Photos and Visual Evidence

You can upload photos as evidence of completed work. By uploading a photo, you confirm that:

FORGE is not responsible for photos uploaded in breach of site rules, privacy laws, or employer policies. That responsibility rests entirely with the person who uploads the content.

Company use of photos for compliance and quality assurance

Where you are employed by or placed with a company that subscribes to FORGE, that company may view and download photos you have uploaded as part of your job records solely for the purposes of compliance review, quality assurance, or workplace safety checks. This does not include use of photos for disciplinary action, termination proceedings, or any employment dispute.

Downloaded photos must be stored securely and used only for those stated purposes. The company may not reproduce, publish, or share your photos — including but not limited to use in internal training materials, marketing, social media, recruitment, or any platform or system outside of FORGE — without your explicit written consent.

Once photos are downloaded from FORGE, the company assumes full responsibility for their security. Any data breach, unauthorised access, or exposure of downloaded photos is the responsibility of the company, not FORGE.

When your employment or placement with that company ends, or when the company’s FORGE subscription is cancelled — whichever occurs first — the company must permanently delete all downloaded photos within 30 days, except where retention is specifically required by Australian law.

Your photos remain your property at all times.

RTOs and GTOs may be granted read-only access to certain aggregated data (skill breadth, work type breakdown, verification rates) only where you have authorised this. RTOs cannot see your photos, job descriptions, supervisor identity, or company goals.

We will never sell your data

FORGE does not sell, rent, or share your personal data with advertisers or third parties for commercial purposes. Your career record is yours.

Data storage and security

Your data is stored securely using Supabase, a cloud infrastructure provider. Data is encrypted at rest and in transit. Supabase infrastructure is hosted in data centres that may be located outside Australia — we take reasonable steps to ensure equivalent protection applies.

FORGE implements role-based access controls, secure authentication, and audit logging to protect your information from unauthorised access.

Data breach notification

In the event of an eligible data breach under the Notifiable Data Breaches scheme, FORGE will notify affected users and the Office of the Australian Information Commissioner as required by law. We maintain an internal incident response process for this purpose.

Data retention and deletion

Worker passport data is retained for as long as your account is active. If you request deletion of your account, your personal data will be removed within 30 days, except where retention is required by law. Company accounts that are cancelled will lose access to worker data immediately — workers always retain their own records.

Your rights

Under the Australian Privacy Act 1988 and the Australian Privacy Principles, you have the right to access, correct, or request deletion of your personal information. To exercise these rights, contact us at hello@joinforge.com.au. We will respond within 30 days.

9. Acceptable Use

You must not use FORGE to:

Fraudulent records can be audited and removed. FORGE reserves the right to suspend or terminate any account in breach of these rules without notice.

10. Limitation of Liability

FORGE provides the platform on an “as is” basis. To the maximum extent permitted by Australian Consumer Law, FORGE’s total liability to you for any claim arising from use of the platform is limited to the fees you paid in the 12 months preceding the claim, or $100, whichever is greater.

FORGE is not liable for indirect, incidental, or consequential losses, including loss of data, loss of income, or business interruption.

Nothing in these Terms excludes rights you have under Australian Consumer Law that cannot be excluded by contract.

11. Changes to These Terms

FORGE may update these Terms from time to time. Updated terms will be posted on joinforge.com.au with a revised date. For material changes, we will notify you by email. Continued use after changes are posted constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of South Australia, Australia. Any disputes will be subject to the jurisdiction of the courts of South Australia.
